The failure of the Company to exercise or enforce any right or provision of the Terms of Service shall not constitute a waiver of such right or provision. The website https://fleximart.ae is owned and operated by Flexitech LLC FZ. Our mission is to provide a secure, quick and safe shopping process in GCC and Arab countries. Our company is a trusted reseller of popular brands such as Google Play, iTunes or PlayStation. All prepaid cards presented on our website may be used at various online shops, e-wallets and more. Gift cards and Vouchers purchased from us can also be used as gift certificates, which means that they can be redeemed on corresponding websites to buy software, games, and many other items. Our products represent digital codes that the client receives immediately after completing the payment and, when applicable mandatory KYC verification.
User Responsibilities
To be eligible for FLEXIMART services, you must be older than 18 years old. To create your account in FLEXIMART and make a purchase, you will have to provide us with some personal information: your name, address, telephone and email address, proof of identity (for more information about how we process the data, please refer to our Privacy Policy). By completing the registration process on our website, you acknowledge that all the information provided is true, accurate and up-to-date. By clicking the confirmation tick box, you give explicit consent to the Terms and Conditions. The client is responsible for complying with all requests made by FLEXIMART and our service providers if needed to authenticate his identity or validate the funding source to his FLEXIMART account. If you are not able to provide us with this information, FLEXIMART has the right to suspend access to your account or even close it.
All the prepaid cards, coupons, e-vouchers, game codes, CD keys, and any other service made available by FLEXIMART (collectively the “Services”) are non-refundable digital items. As it cannot be ascertained whether the product has already been used, the service could be used only once, and the right of withdrawal is not available. The Client is responsible for his choice – by accepting this User Agreement, he acknowledges that he has read the product description carefully and is sure that the electronic goods he has bought are correct and compatible with his device.
You are responsible for keeping your password secure. You are responsible for maintaining the confidentiality of the account and access credentials and are solely and entirely responsible for all activities that occur under your account, whether or not you have authorised such activities or actions. We cannot and will not be liable for any loss or damage from your failure to maintain the security of your account and password.
The User is not allowed to use the Services directly or indirectly for any commercial purposes unless explicitly permitted by FLEXIMART.

You expressly understand and agree that the Company shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, or damages for loss of profits, goodwill, use, data or other intangible losses resulting from the use of or inability to use the Services.
In no event shall we or our partners, vendors, affiliates, subsidiaries, etc., be liable for lost profits or any special, incidental or consequential damages arising out of or in connection with our site, our services or this agreement (however arising including negligence). You agree to indemnify and hold us and (as applicable) our officers, directors, agents, and employees harmless from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of your breach of this Agreement or the documents it incorporates by reference or your violation of any law or the rights of a third party or your use of the Service and our website.

As we have no control over such sites and resources, you acknowledge and accept that FLEXIMART is not responsible for the availability of such external sites or resources and do not endorse and are not responsible or liable for any information, data, text, software, music, sound, photographs, graphics, video, messages, tags, or other content advertising, products or other materials on or available from such sites or resources. As such, you also acknowledge and accept that FLEXIMART does not and is not obligated to examine, evaluate or screen any of these external resources and does not warrant or endorse any of the information, content, offers or claims of these third parties. You further acknowledge and agree that FLEXIMART shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such Content, goods or services available on or through any such site or resource.
Verbal or written abuse of any kind (including but not limited to threats of abuse or retribution and defamatory statements) of any FLEXIMART customer, employee, member, or officer will result in immediate account termination.
You acknowledge and agree that FLEXIMART may at its absolute discretion refuse or permit you to use the Services without giving any reason or notice thereof.
You irrevocably and unconditionally allow and permit FLEXIMART to send you notifications, updates, invitations, newsletters and events offered or provided by us.
Order Process
Our website displays a complete and precise description of prepaid cards, gift cards, vouchers and codes based on information provided by our partners and product suppliers. To complete a purchase, the client is required to enter a valid phone number and email address. A notification of the various payment options is shown at the beginning of the order process. We shall be entitled to change, remove or modify the payment methods available to the customers without prior notice.
Given the products nature, you are required to pay the full due price and all applicable taxes before being supplied with the chosen digital product. This User Agreement shall become effective only after successful payment is made by the client.
We reserve the right to cancel any payment request made by you or refuse to supply the digital item(s) without giving a reason. In the latter case, we shall not collect the payment you made or refund the amount received.
Supply
Our services are usually available on a daily basis unless otherwise specified in the description. Products purchased on our website shall be supplied to you via the e-mail address linked to your account and/or by displaying the code associated with the order directly on the FLEXIMART site. The digital items shall be delivered as soon as we confirm your payment has been received. The supply period shall depend on the chosen means of payment (e.g., payments made with some payment methods such as bank transfers, PayPal, Skrill and credit cards may take up to five business days to process).

Disclaimers and Limitations of Liability

Disputes
If any dispute or claim arises out of or in connection with this User Agreement, the parties should attempt amicably to settle the dispute through negotiations over a period of 30 (thirty) calendar days commencing on the date that a party first sends to the other party written notice of the dispute. If this dispute has not been settled amicably by the parties by the end of 30 days period, the parties hereby agree that the dispute shall be referred to and finally resolved by higher courts.
Governing law
These Terms and Conditions shall be governed by and construed in accordance with the laws of UAE. The courts of UAE have exclusive jurisdiction to settle any dispute arising out of or in connection with this User Agreement.
